Terms of Service

1. Acceptance of terms
By creating an account, accessing, or using CampingHosting, you agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you ('Customer', 'you') and CampingHosting ('we', 'us', 'our'). If you are accepting these terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree to these terms, do not use our platform.
2. Description of service
CampingHosting provides a cloud-based website hosting, content management, and guest communication platform designed for campings and holiday parks. The service includes website hosting on a subdomain (yourname.campinghosting.com), a content management system, a guest information portal, an optional AI assistant, and a booking engine. We provide the tools and infrastructure — you create, manage, and are responsible for your own content.
Trial accounts are provided free of charge for evaluation purposes. Trial accounts may have limited functionality and may be converted to paid plans. We reserve the right to modify or discontinue trial offerings at any time.
We aim to maintain 99.5% uptime for the platform. Scheduled maintenance will be announced at least 48 hours in advance when possible. We are not responsible for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.
3. Account registration and security
To use CampingHosting, you must create an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Promptly notifying us of any unauthorized access or security breach
- Keeping your account information up to date
One person or organization may register multiple camping sites. Each site operates as an independent tenant with its own subdomain, content, and settings. You must not create accounts using false identities or on behalf of others without their authorization.
4. Acceptable use
You agree to use CampingHosting only for lawful purposes related to managing camping or holiday park websites. You must not:
- Use the service for any illegal or unauthorized purpose
- Upload content that is defamatory, obscene, threatening, or that infringes on the rights of others
- Distribute malware, viruses, or any harmful code through the platform
- Attempt to interfere with, compromise, or disrupt the service or its infrastructure
- Scrape, crawl, or use automated means to access the service without permission
- Impersonate another person or entity
- Resell, sublicense, or redistribute the service to third parties without our written consent
We reserve the right to suspend or terminate accounts that violate these guidelines, with or without prior notice depending on the severity of the violation.
5. Your content
You retain full ownership of all content you create, upload, or publish on CampingHosting, including text, images, logos, and other media ('Your Content').
By uploading content to the platform, you grant CampingHosting a limited, non-exclusive license to host, display, and distribute Your Content solely for the purpose of providing the service. This license terminates when you delete Your Content or close your account.
You are solely responsible for Your Content. You represent and warrant that you have all necessary rights to the content you publish and that it does not violate any applicable laws, third-party rights, or these terms.
We do not actively monitor Your Content but reserve the right to remove or disable access to content that we reasonably believe violates these terms, applicable law, or the rights of third parties. We will notify you when content is removed, except where prohibited by law.
6. Intellectual property
The CampingHosting platform, including its design, code, features, documentation, and branding, is owned by CampingHosting and protected by intellectual property laws. Nothing in these terms grants you any right to use our trademarks, logos, or brand elements.
If you provide us with feedback, suggestions, or ideas about the service, you grant us the right to use that feedback without restriction or compensation.
7. Payment and billing
Paid plans are billed in advance on a monthly or annual basis, depending on the plan selected. All prices are in euros and exclude VAT unless stated otherwise.
Payment is due on the date specified in your invoice. We accept payment via the methods listed on our platform. Overdue payments may result in suspension of your account after 14 days written notice.
We may change our prices with at least 30 days advance notice. Price changes take effect at the start of your next billing period. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
Annual subscriptions may be eligible for a pro-rata refund for the unused portion if cancelled within the first 30 days. Monthly subscriptions are not refundable. Trial accounts require no payment.
8. Data processing and privacy
When you use CampingHosting to collect and manage data about your guests (such as booking information), you act as the data controller and we act as the data processor. You are responsible for ensuring that your use of the platform complies with applicable data protection laws, including the GDPR.
As a data processor, we will process personal data only according to your instructions and these terms. We implement appropriate technical and organizational measures to protect personal data, including encryption at rest and in transit, access controls, and regular security reviews.
We may use third-party sub-processors (such as cloud hosting providers) to deliver the service. A list of current sub-processors is available upon request. We will notify you of any changes to sub-processors at least 30 days in advance.
In the event of a personal data breach, we will notify you without undue delay and no later than 72 hours after becoming aware of the breach.
9. Term and termination
You may cancel your account at any time through the platform or by contacting us. Upon cancellation:
- Your access to the admin panel will end immediately
- Your public website will remain accessible for 30 days to allow for migration
- After 30 days, all your data (including content, images, and configuration) will be permanently deleted
- You may request a data export before your account is deleted
We may suspend or terminate your account if you materially breach these terms. For non-urgent violations, we will provide 14 days written notice and an opportunity to cure the breach. For severe violations (such as illegal activity or security threats), we may act immediately.
10. Limitation of liability
CampingHosting is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Our total aggregate liability to you for any claims arising from or relating to these terms or the service shall not exceed the total amount you paid to CampingHosting in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.
11. Indemnification
You agree to indemnify and hold harmless CampingHosting and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, Your Content, your violation of these terms, or your violation of any third-party rights.
12. Governing law and disputes
These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or the use of CampingHosting shall be submitted to the competent courts in Amsterdam, the Netherlands.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
13. Changes to these terms
We may update these terms from time to time. When we make material changes, we will notify you at least 30 days in advance via email or a prominent notice on the platform. Non-material changes (such as clarifications or formatting) may take effect immediately. Your continued use of CampingHosting after the effective date of any changes constitutes your acceptance of the updated terms. If you do not agree with the changes, you must stop using the service and cancel your account.
14. General provisions
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right. These terms, together with our Privacy Policy, constitute the entire agreement between you and CampingHosting regarding the use of the service.
